In a footnote to a ruling last month, NRLB Chairman Marvin Kaplan stated his disagreement with the board precedent stipulating that employers become "perfectly clear" successors to a previous company if they express their plans to hire their predecessor's employees without clarifying that employment would reply on workers accepting new terms.
